The City of Sioux Falls has negotiated a financial settlement regarding the exterior metal siding on the Denny Sanford PREMIER Center.

M. A. Mortenson Company, Sink Combs Dethlefs PC, Koch Hazard, M.J. Dalsin Inc., and Innovative Metals Company, Inc.have agreed to a global financial settlement with the City of Sioux Falls in the amount of $1 million.

“This has certainly been a long and challenging process, but once again the citizens and taxpayers of Sioux Falls will benefit from the efforts of many, including our partners that built our beautiful and ultra-productive Events Center,” says Mayor Mike Huether.

In 2014, the City questioned the aesthetic appearance of the exterior metal siding on the west side of the building. This triggered contract provisions allowing the parties to engage in an informal resolution process. Since that time, the project team and City fully vetted possible options before jointly agreeing to this settlement.

The investigation and informal resolution process concluded that the exterior metal siding is functionally and structurally sound with no need of replacement. Its appearance, while questioned, is not inconsistent with the features of metal siding of its kind.

“The exterior metal siding is structurally sound and doing what it was designed to do operating as a weather barrier and water-tight materials are installed behind the siding. This is a first-class facility with the most modern amenities found in Events Centers today and will be enjoyed for generations to come,” says Mark Cotter, Director of Public Works.

Settlement proceeds will be placed in the City of Sioux Falls Events Center Construction Fund to be used for future fan enhancements and facility improvements at the Denny Sanford PREMIER Center.
