The man accused of driving to South Dakota with his mother's body in the vehicle, is fighting being returned to California.

In a hearing Friday (January 19) Tosten Walsh Lommen declined to waive extradition to California, where he reportedly murdered his mother in her Palm Springs home December 30, 2017. He was arrested January 1 in Rapid City after a high-speed chase that ended at Rapid City when authorities used spikes to pop the tire.

An extradition hearing is now set for February 20.  Friday’s hearing comes after authorities in South Dakota dropped local charges against Lommen in exchange for his extradition to California.

The procedural move by prosecutors cleared the way for Tosten Walsh Lommen, 30, to be returned to California to face a murder charge in that state.

Authorities say they found his mother's body wrapped in a blanket in the back seat of the vehicle he was driving.
