A disgruntled former worker sparked chaos in front of the Empire State Building on Friday when he fatally shot a co-worker and engaged in a gun battle with police, leaving nine others wounded, authorities said. The shooter, identified as Jeffrey Johnson, 58, was one of two killed in an exchange of gunfire with two police officers.

Eric Robert, 50, pleaded guilty to killing Ron Johnson in April 2011 and asked to be executed for the crime. The Supreme Court last week unanimously upheld his death sentence. Attorney General Marty Jackley announced Friday the warrant of execution for Robert has been signed. Execution during the week of October 14, 2012.

Hinder canceled a concert at the Corn Palace in Mitchell just minutes before the band was scheduled to take the stage. Singer Austin Winkler couldn't sing because of strained vocal cords. Fans can get refunds on their tickets.

Train is teaming with San Francisco's legendary Ghiradelli Chocolate Company for its own line of premium chocolate bars, which were unveiled Friday when the band performed on NBC's Today show.
