Was This Murder?

Two kids, 17 and 18, break into a man’s house in Little Falls, Minn.  He shoots them both multiple times.  Both kids are killed.  64 year old Byron David Smith is charged with 2 counts of 2nd degree murder.  He says he was just defending his home from intruders.  When I read this story I read it with special interest.  Not just because I have spent a lot of time in the Little Falls area but because I have always been in favor of gun ownership and ones right to protect his family and belongings.  If two people were breaking into my house you’ve got to know I’d squeeze off as many shots as it takes until I know my family is safe.

This guy used a Ruger Mini 14 and a handgun in the shootings.  He shot the intruders multiple times including what Mr  Smith called “Finishing Shots”.  Here is part of the description of what happened:

Kifer said She was “already hurting,” she let out a short laugh.  He then pulled out his .22-caliber revolver and shot her several times in the chest.  ”If you’re trying to shoot somebody and they laugh at you, you go again,” Smith told investigators, according to a criminal complaint filed Monday.

Smith told investigators he was fearful after several break-ins at his remote home in Little Falls, a central Minnesota town of 8,000 people. The sheriff’s office had only one report of a break-in, on Oct. 27. Smith reported losing thousands of dollars in cash, gold coins, two guns, photo equipment and jewelry.

Wetzel said that while the shootings happened on Thursday, Smith waited until Friday to report the deaths, explaining that “he didn’t want to trouble us on a holiday.”

As you read more reports of what transpired you have to ask yourself if Mr. Smith was justified or if he deserves to go to prison for what he did?  What would you have done is someone was breaking into your house?  Did those kids deserve what they got for breaking the law?
